I think Brian has a right to write a song and have the credits be in his name because Sarah had given him the poem earlier and because she had not copyrighted the poem. If Sarah has questions, I think she should contact a lawyer and ask for advice, but I think Brian had a right to rewrite the poem into a song without her consent and without paying her royalties.
